Les syndiqués n'en ont pas encore terminé avec l'affaire de l'excédent de la caisse de retraite de 28 milliards $ que s'était approprié le gouvernement fédéral au milieu des années 90. L'Alliance de la fonction publique du Canada a annoncé qu'elle avait décidé de déposer une requête en autorisation d'appel devant la Cour suprême du Canada, contestant ainsi la décision rendue en octobre par la Cour d'appel de l'Ontario dans le dossier de l'excédent de la caisse de retraite de 28 milliards $. Depuis le début des procédures juridiques, un groupe de syndicats représentant 700 000 employés et retraités fédéraux conteste le fait que, le fédéral ait pu s'approprier l'excédent de 28 milliards $ des caisses de retraite de la fonction publique, de la GRC et des forces armées canadiennes grâce à des modifications législatives visant à restructurer les régimes de pension. Dans sa requête, l'AFPC allègue ainsi « que le gouvernement a abusé de la confiance des cotisants au régime de retraite allant ainsi à l'encontre de ses obligations fiduciaires ». L'automne dernier, la Cour d'appel de l'Ontario avait statué que le gouvernement fédéral pouvait, à son gré, piger dans l'excédent de la caisse de retraite, même si cela entraînait une hausse des cotisations versées par les employés fédéraux. L'AFPC conteste aussi les conclusions du juge de première instance selon lequel les caisses de retraite n'avaient pas accumulé d'actifs. Le syndicat soutient toujours que la preuve avait démontré que le gouvernement devait mettre de l'argent de côté et l'a fait pour répondre à ses obligations. « Ces fonds avaient été déposés avec les cotisations des membres » a tenu à rappeler l'AFPC.
