I believe that Sowaar Bar was unfairly treated in that they were not duly informed of their rights and obligations in terms of the rental agreement. Secondly the Bar could not have reasonably known that they could not have shows there and therefore the landlord should have either informed them at the signing of the contract or throughout the lease agreement.

It is the obligation of the landlord to properly zone this commercial premises prior to the tenants occupation (unless otherwise agreed between the parties), the commercial premises are let to the tenant for a specific purpose and is to ensure that that the premoses (and zoning) is fit and proper for that purpose. Landlords are to provide an environment for tenant to operate. Here is a good example.

Lets say you rent a residential house to a business entity doing business at the residential address.

Suddenly the lanldord receives a fine for not paying business rates for the property, but then passes that fine over to the tenant - an entity with no means to zone the property as they are not the owners of such property and they entered the premises for the purpose of doing commercial activities with the landlord's consent.

Landlord as a result of lack of doing what is needed to zone the property and adjust the rental therefor is liable.

The Man Motels played a show there last year with Shadow Club and it was one of the best, if not the best experiences I've had while performing at a venue. The most professional. Super hospitable. I’m signing this given I’ve been experiencing the music scene in Johannesburg since the mid 90’s, and the one thing I know for sure is that there are not enough people and businesses that support the live music industry in South Africa. COVID-19 and the lockdowns in South Africa effectively destroyed our live music industry, and I find it unacceptable that situations like this are occurring.
